Resolving workplace disputes - consultation response

The NHS Employers organisation has submitted a response, on behalf of NHS organisations, to the Department for Business Innovation and Skills consultion on proposals for changing the handling of workplace disputes and the employment tribunal (ET) system.

Thank you to all who responded to our survey on “Resolving workplace disputes: A consultation”. Following your feedback we have submitted a response to the Department for Business Innovation and Skills.

 

Our response

Our response was based on the clear views of employers in the NHS on how workplace disputes can be more effectively managed to prevent them becoming the subject of claims in Employment Tribunals and to ensure that  those claims that do reach Tribunals are managed as quickly and effectively as possible.

While a range of views was expressed on each issue, employers were very supportive of the main thrust of the proposed changes, with large majorities in favour of:

  • increasing deposit orders
  • increasing the cap on the level of costs awarded by tribunals and
  • providing an initial statement of loss on the ET1 form.

There were also smaller, but still significant majorities in favour of the use of ACAS before claims are lodged and extending the length of the qualifying period for claiming unfair dismissal.
