Pay protection for doctors in training

In response to frequent requests from employers, NHS Employers has taken advice from employing organisations, professional and legal advisors and other stakeholders to produce a paper setting out its understanding of the purpose and application of pay protection in respect of junior doctors on rotational appointments. The paper addresses both basic eligibility and the calculation of protected pay.

Current contractual arrangements

The current contractual arrangements for doctors in hospital and public health training have been in force since December 2000.

• Terms and Conditions of Service (TCS) (version 9, March 2008)
  This handbook sets out the Terms and Conditions of Service of Hospital Medical and Dental Staff and doctors in Public Health Medicine and the Community Health Service in England and Wales. It supersedes the handbook issued in 1994, and incorporates all amendments agreed between the Secretary of State and the medical and dental professions as at 31 March 2008.
• Record of amendments to the TCS Volume 1 (1 December 2002 to 30 July 2007)
• Record of amendments to the TCS Volume 2 (31 March 2008 to date)
• Statement of particulars of employment forming part of the contract for hospital medical and dental staff in training - September 2008. This supersedes annex C of AL(MD)1/2001.
• Record of amendments to the contract
• For specialist and specialty registrars it will be necessary to incorporate into the model contract, paragraphs from the previous contract for SpRs set out in AL(MD)2/1996.
