NHS employers 1. European Working Time Directive – new FAQs NHS employers
With just two months to go until the 1 August deadline for implementing the 48-hour working week for junior doctors, NHS Employers has published a number of frequently asked questions (FAQs) about the working time regulations. The FAQs include information on opting out of the working time directive and what individuals are able to opt-out from, how the use of internal locums may be affected by the new rules, an update on the DH derogation process and how to protect both the quality of care for patients and quality of training for junior doctors. The full set of FAQs is available to download from our Working Time Directive web pages.

NHS employers 2. EU agency workers’ directive consultation NHS employers
The Department for Business Enterprise and Regulatory Reform (BERR) has launched a consultation paper on bringing the EU Agency Workers Directive (AWD) into UK law. The Directive aims to protect temporary agency workers through the application of the principle of 'equal treatment' compared to permanent staff, covering issues such as pay, benefits and access to training. With a relatively high percentage of all agency workers covered by the directive engaged within the NHS, NHS Employers will be consulting with employers on the implications of the directive and identifying key areas requiring further clarification. For more information about the consultation and a series of BERR events please visit our flexible workforce web page.

NHS employers 3. NHS named among top employers for working families NHS employers
The NHS has been named among England’s top employers for working families by the work-life balance charity Working Families. More than 20 public and private organisations were recognised by the charity, based on their leadership in one or more of the following areas: flexible working, childcare provision, maternity and/or paternity policy and help with elderly care responsibilities. Such was the strength of submissions from NHS organisations that the expert panel of judges chose to acknowledge the NHS collectively as an employer that offers excellent benefits to working families. Read our press release.

The Joint Negotiating Committee has agreed the following updates to the frequently asked questions (FAQs) for Specialty and Associate Specialist (SAS) doctors. Question 21 has been revised to reflect the new contract becoming available; question 67 gives advice on assimilating doctors to the new contract and working patterns; question 65 looks at assimilation when a doctor has an incremental date of 1 April; and question 66 addresses what happens with progression through pay thresholds when a doctor is away on maternity leave. The updated questions can be viewed on the pay and contracts section of our website.
