The Right to work check standard outlines the requirements for NHS organisations to verify a prospective employee's legal right to work in the UK.
The standard has been updated to reflect a recent change to the immigration rules which removes the labour market restrictions on individuals from Bulgaria and Romania. This means that from 1 January 2014 nationals from Bulgaria and Romania will no longer be subject to Immigration and Worker Authorisation Regulations 2013 and they will be free to take up employment in the UK.
Employers are reminded that it remains a requirement to ask nationals from all EEA countries and Switzerland to prove their nationality by producing one of the documents, or combinations of documents, as specified within the right to work checks standard which can be found on our NHS Employment Check Standards web pages.
