A fit and proper person test briefing document has been published to help employers understand the requirements placed on NHS provider organisations to ensure director level appointments meet the ‘fit and proper persons test’.
Employers should read the briefing document in conjunction with CQC guidance for NHS bodies which was published on 20 November 2014.
The new requirements came into force for all NHS bodies required to register with the Care Quality Commission (CQC) from 27 November 2014 and is integrated into CQC’s registration requirements.
As well as providing a summary of the regulations, the briefing can be used as a practical tool for boards to seek assurance that they have followed robust and due process in meeting the fit and proper person requirements when making board level appointments.
The briefing document was produced by NHS Employers, the NHS Confederation and NHS Providers (formerly the Foundation Trust Network).
