A landmark ruling on whether travel time can be counted as working time could have implications for the NHS.

Where staff are based at home and are required to travel from their own home to patients in the community, local policies should be reviewed to ensure compliance with the European Working Time Directive (EWTD).

In a recent decision, Federacion de Servicios Privados del sindicato Comisiones obreras v Tyco Integrated Security SL, the European Court of Justice ruled that where workers have no fixed place of work, the time spent travelling between home and their first and last customer is considered working time under the EWTD.

Further information about the case is available on the Capsticks website.
