Arrangements for bank holidays over Christmas and New Year holidays 2005/06 (England)

 
  1. Agenda for Change provides eight paid general public holidays each year including Christmas day, Boxing day (26 December) and New Year's day.

    Agenda for Change provides eight paid general public holidays each year including Christmas day, Boxing day (26 December) and New Year's day. The Agenda for Change provisions relating to Christmas and New Year are in Section 2 paragraphs 32 and 33 of the NHS Terms and Conditions of Service Handbook.

    "2.32 - When public holidays during the Christmas and New Year period fall at weekends then alternate days will be designated as if they were paid public holidays and the appropriate payments applied.

    2.33 - Where staff are required to work on what otherwise would have been a public holiday other than the provisions of 2.32 above, then the appropriate agreements (see Annex D) relating to work on public holidays and weekends will apply to those days. However, staff will not receive additional payments for both the alternate days and the days that would otherwise have been public holidays."

  2. Christmas day 2005 and New Year's day 2006 fall on Sunday. The list below indicates how these provisions apply.

    Saturday 24 December 2005
    The normal provisions for work on a Saturday apply.

    Sunday 25 December
    The provisions for work on a public holiday apply. Except that any employee working on all three of these days will be entitled to a maximum of two public holidays and one 'Sunday'.

    Monday 26 December
    The provisions for work on a public holiday apply.

    Tuesday 27 December
    The provisions for work on a public holiday apply.

    Sunday 1 January 2006
    The provisions for work on a public holiday apply. Except that any employee working on both of these days will be entitled to a maximum of one public holiday.

    Monday 2 January
    The provisions for work on a public holiday apply.

  3. The rate of pay you receive will be that which would normally apply to public holiday working.

  4. Local partnerships are free to vary these provisions to meet local operational needs so long as there are no more than three bank holidays in the combined Christmas and New Year holiday period.
