Postgraduate doctors and dentists

 

In order to be eligible to access medical or dental training in the NHS, individual doctors and dentists must have the right to work in that profession in the UK. They will either be entering Foundation Programme training or specialty training.

For those doctors who are accessing non-training posts, employers need to follow the non-training category guidelines.

Foundation Programme

Eligibility for the Foundation Programme is detailed by the UK Foundation Programme Office and full details can be found on the Foundation Programme website.

NHS employers will need to ensure that any offers of appointment are made in line with the current rules for Foundation Programme recruitment.

Applicants need to be:

  • a UK or EEA national
  • a student of a UK medical school in their final year of study and be eligible to apply for the postgraduate doctors and dentists visa
  • have the right to work in the UK on 1 December 2008 which remains valid until the start of the Foundation Programme in August 2009

Specialty training

Eligibility for specialty training is contained within the Gold Guide which can be found on the MMC website.

UK, EEA nationals and doctors whose immigration status entitles them to work as a doctor in training in the UK are eligible to apply for specialty training. Evidence of immigration status would be a date stamped passport and an accompanying letter from the Home Office, detailing which type of visa has been granted. Both documents would need to be dated as at or prior to the training application closing date.

Other non-UK or non-EEA nationals with limited leave to remain in the UK, whose employment will require a work permit, are subject to the resident labour market test. This would include, for example, doctors on student or working holiday visas, or those in the highly skilled category of the points-based system, Tier 1 (General), who are restricted from taking employment as a doctor in training. The labour market test means that they would only be considered if there were no suitable UK or EEA national candidates for the post. Employers need to check the individual's passport for proof of their immigration status.

Non-training posts

These posts can include those with the title of trust doctor, clinical fellow, specialty doctor and consultant, amongst others. They cover all posts that do not carry an official training number allocated by the postgraduate dean.

The employer will need to apply for a work permit for the individual successful applicant if they are not a UK/EEA resident or does not possess:

  • HSMP/Tier 1 (General) visa
  • Another category of visa that allows them to undertake work in this profession (each individual visa will need to be checked to confirm status)
