System working - guide to support workforce sharing


A new guide offers practical advice and guidance on the employment law issues that might arise when staff work across different NHS organisations.

As organisations and integrated care systems (ICS) develop ways of collaborative, place-based patient care, System working - staff mobility/portability guidance for employers supports staff movement across NHS organisations as part of workforce sharing agreements.

It includes:

  • advice on developing workforce sharing agreements
  • useful templates and practical issues to consider
  • legal considerations to be taken into account by employers.

The guide also includes case studies on where workforce sharing is working effectively, and we will add more case studies as more organisations share their learning.

NHS England commissioned NHS Employers to produce the guide, which we developed in collaboration with Capsticks Solicitors LLP. It was also informed by employers and staff side colleagues from the Social Partnership Forum.

The guidance is designed to be read alongside existing policies and procedures, and it encourages early engagement with staff and trade unions when developing any workforce sharing approaches.
