NHS terms and conditions changes from 1 April 2021

The following changes to the NHS terms and conditions of service take place from 1 April 2021.

The NHS Staff Council has endorsed changes to the following sections and annexes of the NHS terms and conditions of service (NHS TCS) handbook. These changes take effect from 1 April 2021.

Annex 1: updates have been made to the entities considered as employing organisations for the purposes of the NHS TCS.

Annex 2: the presentation of the pay structure has been amended to reflect the completion of reform to all pay bands effective from 1 April. There are no changes to the pay values.

Annex 3: the pay scales for the period 1 April 2018 to 31 March 2021, developed for 2018 pay deal, have been archived in to this section.

Section 1: Pay Structure (England): amendments have been made to the provisions for annually earned points to ensure staff do not drop to the entry point where the element of re-earnable pay is not retained. Employers will need to locally consider the criteria for the 5 or 10 per cent deduction of pay as, at this time, there is no intention to develop NHS Staff Council guidance on this. All the pay on promotion provisions have been relocated in to this section.

Section 2 (England): the 2018 and 2019 unsocial hours rates have been removed. The provisions for pay on promotion have been relocated to Section 1 (England).

Section 6 (England): pay on promotion provisions, including those for temporary movements, have been relocated to Section 1 (England).

Section 15: Leave for new parents (England, Wales & Scotland): new provisions for England, Wales and Scotland have been included which provide for the use of notional full pay where mothers (maternity leave) or primary carers (adoption leave) take periods of consecutive leave.
