On 30 July 2020 the British Medical Association (BMA) informed us of its withdrawal from the joint statement, which details the application of contractual protections during the pandemic for consultants, consultant clinical academics and SAS doctors.
This was jointly agreed as a response to the service pressures and challenges presented by the COVID-19 pandemic.
This will have the effect of terminating any agreed contractual flexibilities at local level and reverting the contractual position to that set out in the Terms and Conditions of Service for consultants, consultant clinical academics, specialty and associate specialists from 1st August 2020.
We had advised the BMA that employers remained content to stay within the terms outlined in the joint statement. We recognise that the impacts of the pandemic are still not fully ended and that many organisations are still in recovery mode. We continue to work together to review the need for any future reinstatement of the terms outlined in the joint statement, or implementation of similar alternative measures, should the demand placed on the NHS by COVID-19 services grow.
The BMA has also withdrawn from a similar joint statement regarding doctors and dentists in training and we have published this statement.
