Guidance note on the calculation of annual leave
Q. During COVID-19 where doctors have not been able to take leave this is being paid by employing organisations. How do employers establish payment for any untaken leave?
A. The amount of the payment or repayment should be based on accrued salary for the leave year calculated in accordance with the locally agreed policy. Where there is no locally agreed policy in place the method of calculation will need to be considered before completing the model contract.
To support these local considerations, we have published a guidance note which sets out the current case law related to this issue. Employing organisations will need to keep under review case law as it develops should a review of your position be necessary.
The BMA and NHS Employers do not have a shared view on how the terms and conditions of service should be interpreted. We are continuing to discuss and explore with the BMA options to how greater clarity can be introduced.
