Consultation on extending the right to work scheme

Learn more about the plans to extend legislation to prevent illegal working.

The Home Office is consulting on the implementation of right to work checks in a wider part of the labour market, affecting the gig economy, self-employed people and zero-hours contract workers.

The consultation seeks views on how this change should be operationalised and enforced, and how processes can be simplified to make it easier for employers to fulfil their responsibilities.  

Although this amendment should not affect existing right to work check requirements in the NHS, responses from all sectors will support the evaluation of the impact of the changes on illegal working. It will also help to inform the preparation of guidance and the statutory code of practice that supports the scheme. 

The consultation closes at 11:59pm on Wednesday 10 December 2025. Respondents can complete the questionnaire online or return a downloadable version to the Home Office via email
