Government’s call for evidence on TUPE regulations
The Transfer of Undertakings (Protection of Employment) Regulations (TUPE) provide protections for employees that are moved between or within companies and other organisations. The TUPE Regulations also provide a framework for businesses undergoing mergers and acquisitions on how to manage staff transfers.
As part of the Plan to Make Work Pay, the government intends to strengthen the existing set of rights and protections for employees subject to the TUPE processes.
To support this, the government is seeking responses about experiences with current TUPE processes from a wide range of employers, business representatives, employees and employee representatives.
In particular, this evidence will be used to focus on:
- understanding the prevalence of TUPE transfers
- understanding experiences with current TUPE processes
- how to better ensure TUPE is easy to follow for businesses to support growth and create a better environment for businesses to expand, sell, or merge
- how to strengthen the existing set of rights and protections for those subject to TUPE to create a more stable workforce during transitions
- developing policy proposals for reform.
