Updated guidance on settlement agreements and confidentiality clauses
NHS Employers has updated its guidance about settlement agreements and confidentiality clauses following changes to the Employment Rights Act (ERA).
Working with legal partner Capsticks LLP, we have made several updates to the guidance, which include:

occurrence of sexual harassment added to list of protected disclosures

information and legal requirements relating to the Victims and Prisoners Act 2024

amendments to terminology/definitions

links to additional guidance and resources.
Employers need to be aware that information relating to the Permitted Disclosures clause has been updated and therefore employers should ensure that this revised clause is included within any settlement agreements.
