NHS terms and conditions of service advisory notice 02/2024

This notice advises of the publication of version 54 of the NHS Terms and Conditions of Service Handbook. The list of amendments are detailed below:

Amended Section 33: Balancing work and personal life (England, Wales & NI)

Paragraph 33.23 amended to reference the statutory Carers Leave Act 2023, in force on 6 April 2024. 

Paragraph 33.28 amended to include provision for employees’ day 1 statutory right to unpaid leave, per the statutory Carers Leave Act 2023.

Paragraphs 33.5, 33.13 and 33.16 amended to reflect the Employment Relations (Flexible Working) Act 2023 (in force on 6 April 2024), including the requirement for employers to consult employees before refusing flexible working requests.

AmendedSection 27: Working time regulations Paragraphs 27.20, 27.21 and 27.23 amended to reflect existing Working Time Regulations (1988), specifically the regulations’ inclusion of regular overtime in the calculation of ‘normal hours’ for night workers.

This notice advises of the publication of version 53 of the NHS Terms and Conditions of Service Handbook. The list of amendments are detailed below:

NewSection 2: Maintaining round the clock services (Northern Ireland) 
  • The addition of a new section on maintaining round the clock services, specific to the Northern Ireland devolved administration.
  • Table 2 reflects the latest unsocial hours rates.

  • Section 1: Maintaining round the clock services (Scotland and Northern Ireland) amended to apply specifically and solely to the Scotland devolved administration.
  • References to a historic ambulance service have been removed. 
NewSection 6: Career and pay progression (Northern Ireland)The addition of a new section on career and pay progression, specific to the Northern Ireland devolved administration.

  • Section 6: Career and pay progression (Scotland and Northern Ireland) amended to apply specifically and solely to the Scotland devolved administration.
  • The revised Section reflects Scotland’s approach to career development and incremental progression agreed as part of the 2018 Agenda for Change pay deal. 
  • The grounds for deferral of pay progression removed for relevance. 
AmendedSection 15: Leave and pay for new parents Section 15: Maternity leave (Northern Ireland) removed; Section 15: Leave and pay for new parents covers England, Wales, Scotland and Northern Ireland.
AmendedSection 15: Leave and pay for new parents Paragraph 15.112 amended to reflect legislation changes to statutory paternity leave and pay regulations, with effect from 8 March 2024 in England, Scotland and Wales.
AmendedSection 23: Child bereavement leaveSection 23 Child Bereavement leave (England, Wales and Scotland) superseded with this Section 23: Child bereavement leave, which covers England, Wales, Scotland and Northern Ireland. 
AmendedSection 40: National Bodies and procedures ‘Deputy First Minister for Health, Social Services and Public Safety’ removed, and replaced with ‘Deputy First Minister for Health’, for accuracy. 
AmendedAnnex 1: NHS EmployersAnnex 1 employers in England updated: Clinical commissioning groups and The NHS Commissioning Board removed; Monitor (NHS Improvement), NHS Trust Development Agency (NHS Improvement), and The Health and Social Care Information Centre refreshed and restructured for accuracy.
