DBS checks for self-employed people and personal employees

Due to ongoing amendments to the Crime and Policing Bill, self-employed people or personal employees, who work with children or vulnerable adults will now be able to apply for enhanced Disclosure and Barring Service (DBS) checks. 

Those eligible can apply for the higher level DBS checks through an umbrella body. If an organisation is contracting a self-employed person to carry out work which would be eligible for a higher level DBS check, the organisation can continue to do so.

This change and the related guidance only applies for the following:

  • those who are in regulated activity with children and/or adults, to get an enhanced with barred list check
  • those carrying out activities which would have been regulated activity with children and/or adults before Section 66 of the Protection of Freedoms Act 2012, to get an enhanced check
  • those who carry out activities with children infrequently, which if carried out frequently would be regulated activity, to get an enhanced check.

Anyone intending to use the services of a self-employed person or personal employee may ask to see their enhanced or enhanced with barred list check to inform their decision on the suitability of doing so.
