ICO consultations open on draft employment practices

The two consultations relate to recruitment and selection processes and keeping employment records.

The Information Commissioner’s Office (ICO) is seeking feedback on its draft guidance pertaining to employment practices and data protection, which it plans to publish as an online resource.

The ICO is the UK’s independent body which upholds information rights in the public interest. The resource will contain practical guidance about how to comply with data protection law when carrying out recruitment exercises and also aims to promote good practice.

Employers should be aware that this could potentially impact on their own recruitment practices and processes, once the guidance is confirmed and published. For example, the stage in the recruitment process when employers should request a criminal record self-declaration may change.  

If this is the case, we will update the employment checks standards accordingly and ensure that employers are informed of the updates.

If employers wish to submit a response, both consultations will remain open until 5pm on Tuesday 5 March 2024.
