PSA consultations on regulatory rulemaking and fitness to practise

New guidance for healthcare professional regulators is open to public consultation following government reforms to regulation.

22 February 2024

The Professional Standards Authority (PSA) is seeking feedback on two draft guidance documents that will support regulators in using their new powers around rulemaking and fitness to practise.

The reforms will give professional regulators much greater flexibility both in how they develop their regulatory processes but also in how they make decisions about individual healthcare professionals.

This is relevant to employers within the NHS as they may have to work closely with professional regulators both in relation to managing and escalating complaints about healthcare professionals and sometimes on wider issues to do with workforce planning and patient safety.

The guidance is intended to encourage a robust approach to make regulation better, fairer, simpler and more consistent and the PSA wants to ensure it helps achieve what employers would want to see from the reforms.

The affected regulators include:

  • General Dental Council
  • General Medical Council
  • General Pharmaceutical Council
  • Health and Care Professions Council
  • Nursing and Midwifery Council

The consultation is open until 5pm on Monday 15 April 2024. If employers wish to make a submission they should respond using the online survey.
