Updated flexible working guidance

Section 33 of the NHS Terms and Conditions of Service Handbook and supporting guidance has been amended to align with recent legislation changes.

Following our recent update on April 2024 legislation changes, we have updated the following guidance to align with The Employment Relations (Flexible Working) Act 2023 that came into effect on the 6 April 2024. 

The NHS Terms and Conditions of Service (TCS) Handbook has been updated in line with these changes. In addition, the following guidance has been updated:

Upcoming guidance for joint union-employer partnerships on reviewing flexible working policies will be published soon.

The NHS Electronic Staff Record (ESR) has published a user notice which reflects how you can record flexible working requests following the legislation changes.
